Welcome to Sharper.video. These Terms of Service ("Terms") govern your access to and use of sharper.video, free.sharper.video, and the related AI video generation, video editing, video enhancement, and other tools and services offered through these websites (collectively, the "Services").

The Services are operated by Windvale LLC, a limited liability company registered in Wyoming, United States ("Windvale LLC," "we," "us," or "our").

By accessing or using the Services, creating an account, or purchasing a paid plan or credits, you agree to these Terms. If you do not agree, please do not use the Services.

These Terms should be read together with our Privacy Policy and Refund Policy. Nothing in these Terms limits any mandatory consumer rights or legal protections that cannot lawfully be excluded.

01

Our Services

Sharper.video provides online tools for creating, editing, enhancing, and transforming videos. Depending on availability, supported features include:

  • AI Video Generator, including text-to-video and image-to-video generation.
  • AI Video Editor for modifying videos using artificial intelligence.
  • Video Extender for generating additional footage.
  • Video Upscaler for AI-powered video enhancement, resolution improvement, and frame-rate processing.
  • Free browser-based tools for video upscaling, cutting, cropping, conversion, and other supported editing tasks.

Some features are available without creating an account, while others require registration, free credits, purchased credits, or a paid plan.

Available features, supported file formats, resolutions, processing times, model options, and usage limits may vary depending on the selected tool, your device, and service availability.

We may improve, update, replace, or discontinue individual features for technical, security, legal, or business reasons, subject to applicable law and any obligations relating to paid Services.

02

Eligibility and Accounts

The Services are intended for individuals aged 18 or older who are legally permitted to enter into an agreement under applicable law.

By registering or using the Services, you confirm that you meet these eligibility requirements. If you use the Services on behalf of a business or organization, you confirm that you have authority to act on its behalf.

You agree to provide accurate account information, protect your login credentials, and take reasonable steps to prevent unauthorized access.

You are responsible for activity conducted through your account, except to the extent caused by circumstances for which you are not legally responsible. Please notify us at [email protected] if you believe your account has been accessed without authorization.

You may not sell, transfer, or share access to your account in a manner that violates these Terms.

03

Free Browser-Based Video Tools

Sharper.video offers free video editing and processing tools, including tools available through free.sharper.video.

Our browser-based local processing tools operate on your device. Videos selected for these tools are processed locally rather than uploaded to our cloud AI video generation system.

We do not store videos uploaded or selected for our free video editing tools on our servers. For locally processed features, your source video and processed output remain on your device unless you independently choose to save or share them.

Technical capabilities may depend on browser support, device memory, processing power, supported media formats, and local storage availability.

Because these tools operate within the capabilities of your device and browser, some videos may not process successfully on every device. We may display technical requirements and supported formats to help you select compatible files.

Using a free local tool does not, by itself, authorize Sharper.video to retain or publish your video.

04

Cloud AI Video Processing

Our cloud-based AI features require data to be transmitted for processing.

When you use AI video generation, image-to-video, video extension, AI editing, or cloud video enhancement, your submitted text prompts, images, videos, selected settings, and other information necessary to perform the task may be processed by our systems and authorized third-party AI or infrastructure providers.

These providers may perform video generation, enhancement, rendering, technical processing, and content safety checks on our behalf.

Cloud processing is separate from the local processing provided by our free browser-based tools.

Generated or processed videos may be stored within your account so that you can preview, manage, download, or delete them.

Your account videos are not automatically published in a public gallery or made available to other Sharper.video users. We do not use private account videos as public promotional examples without your authorization.

Further information about data processing is provided in our Privacy Policy.

05

Your Content and Ownership

"User Content" includes text prompts, images, videos, audio, instructions, and other materials you submit to the Services.

You retain the ownership rights you have in your User Content.

You confirm that you own your submitted materials or have the permissions, licenses, consents, or other legal authority necessary to upload and process them through the Services.

You must not upload or use content that infringes another person's copyright, trademark, privacy, publicity, or other legal rights.

You grant Windvale LLC and its authorized service providers a limited, non-exclusive, worldwide license to host, transmit, reproduce, process, modify, and otherwise use User Content only as reasonably necessary to provide the requested Services, operate and secure the platform, conduct permitted content safety reviews, address abuse, and comply with applicable law.

This license does not transfer ownership of your User Content to Windvale LLC.

We do not claim ownership of your original videos, images, or prompts simply because you use our tools.

06

AI-Generated Videos and Output Rights

"Output" means videos, images, audio, or other materials generated or modified through the Services.

As between you and Windvale LLC, you retain any rights you may legally have in Output generated for you, subject to applicable laws, third-party rights, and restrictions clearly disclosed for your selected feature or plan.

You may use your Output for lawful personal or commercial purposes where permitted by the applicable feature or plan and relevant law.

However, AI-generated content may not always qualify for copyright protection, and similar or identical outputs may be generated for other users.

We do not guarantee that any Output is unique, copyrightable, free from third-party claims, or suitable for a particular commercial or legal purpose.

You are responsible for reviewing your Output before publishing, distributing, advertising, selling, or otherwise using it.

You must obtain any necessary third-party permissions for recognizable individuals, protected works, trademarks, voices, or other materials included in your Output.

Nothing in these Terms gives you ownership of third-party AI models, software, or other technology used to provide the Services.

07

Acceptable Use and Prohibited Content

You agree to use the Services lawfully, responsibly, and in a way that respects the rights and safety of others.

The following uses are prohibited:

  1. Creating, requesting, uploading, or distributing child sexual abuse material, sexualized depictions of minors, or other material involving the sexual exploitation or abuse of children, including AI-generated or manipulated material.
  2. Creating or distributing non-consensual intimate imagery, sexual deepfakes, exploitative sexual content, or explicit pornography prohibited by our content safety requirements.
  3. Using another person's likeness, voice, identity, or private material in a manner that violates their rights, including unauthorized sexualized depictions or harmful impersonation.
  4. Producing fraudulent, deceptive, defamatory, threatening, or unlawfully harassing content.
  5. Creating or distributing content that unlawfully promotes violence, terrorism, human exploitation, or other serious criminal activity.
  6. Uploading or generating material that infringes intellectual property rights or violates applicable privacy or data protection laws.
  7. Using AI-generated material to impersonate a real person, fabricate evidence, mislead others about real events, or commit fraud.
  8. Attempting to bypass safety restrictions, content filters, access controls, account limitations, or payment systems.
  9. Introducing malicious code, attacking our infrastructure, interfering with other users, or engaging in unauthorized automated access.
  10. Reselling unauthorized access to the Services or using our infrastructure in a way that materially disrupts normal operation.

If you submit images or videos depicting minors for an otherwise permitted and non-sexual purpose, you must have the necessary legal authority and permissions to use those materials. Sexual exploitation or sexualized generation involving minors is strictly prohibited, regardless of whether the depiction is real, altered, or entirely synthetic.

We may apply additional restrictions where necessary to comply with applicable law, safety standards, or requirements imposed on the services and payment systems we use.

08

AI Content Safety and Third-Party Moderation

We take reasonable steps to prevent misuse of our cloud AI features and to protect users, individuals depicted in submitted materials, and the broader community.

To support these purposes, we may use automated systems, authorized third-party content moderation providers, and appropriate human review to assess content submitted to or generated by our cloud AI Services.

Depending on the feature and the circumstances, content submitted for safety assessment may include text prompts, uploaded images, video files, and generated or modified Output.

Safety checks may be conducted before, during, or after processing to identify potentially unlawful or prohibited content, including child sexual exploitation material, sexualized representations of minors, non-consensual intimate imagery, serious threats, and other violations of applicable law or these Terms.

Authorized third-party safety providers may process information necessary to perform these checks, subject to applicable privacy and data protection requirements.

These cloud content moderation arrangements do not change our commitment not to store videos selected for our free browser-based local editing tools.

We may reject a prompt, prevent generation, restrict access to particular features, remove prohibited content, or suspend an account where we reasonably determine that doing so is necessary to enforce these Terms, protect users, or comply with legal obligations.

Automated systems are not perfect. A content review may occasionally reject permissible material or fail to identify prohibited content.

If you believe a moderation decision was made in error, you can request a review by contacting [email protected]. Where applicable law requires additional information about a restriction or a particular review procedure, we will provide it.

09

Responsible Use of AI-Generated Media

AI-generated and AI-modified videos can appear realistic even when the events or people shown are fictional or have been digitally altered.

You must not deliberately present misleading AI-generated media as genuine evidence or use it to deceive, defraud, exploit, or unlawfully harm others.

When required by applicable law, you are responsible for appropriately disclosing that content has been generated or materially altered using artificial intelligence, particularly where realistic depictions of individuals or events could mislead viewers.

You must not intentionally remove or misrepresent legally required AI-content disclosures, provenance information, or technical authenticity indicators.

The Services are creative and technical tools. They are not intended to verify the truth, authenticity, or accuracy of real-world events.

10

Credits, Pricing, and Paid Services

Certain Sharper.video features require credits or a paid plan.

Before starting a credit-based task, the Services display the applicable credit requirement based on the selected feature and settings.

Credits may be provided through free promotions, account benefits, subscriptions, or separate purchases.

Credit amounts, pricing, available features, plan duration, applicable taxes, and any disclosed usage or expiration conditions are presented through the relevant pricing or purchase process.

Credits are digital service entitlements rather than currency. They are not legal tender, do not earn interest, and may not be sold, transferred, or exchanged for cash except where required by applicable law or expressly permitted by us.

When you authorize a processing task, the applicable credits may be deducted from your available balance.

If a video generation task fails, the credits charged for that failed task are automatically returned to your account. If your balance does not reflect an expected return, contact [email protected].

Free credits and promotional benefits may be subject to reasonable anti-abuse controls and any terms disclosed when they are granted.

We may update prices or credit requirements prospectively. Any applicable changes to recurring paid plans will be communicated as required by law.

11

Payments and Subscriptions

Paid purchases are processed through authorized payment service providers.

The applicable price, currency, billing terms, and payment information are displayed during checkout. The merchant or payment service provider responsible for processing your transaction may also be identified at checkout or on your receipt.

By completing a purchase, you authorize the applicable payment and agree to pay the amount disclosed before you confirm your order.

If you choose a subscription that automatically renews, the renewal frequency, applicable renewal price, and material billing conditions will be presented before purchase.

An automatically renewing subscription continues for successive billing periods until you cancel it or it otherwise ends in accordance with the applicable terms.

You can stop future automatic renewals using the available subscription or billing controls. If you need help cancelling, contact [email protected].

Cancellation normally stops future renewals while allowing access for the remainder of the paid billing period, unless otherwise disclosed or required by applicable law.

Cancelling a subscription does not automatically reverse charges for previous billing periods. Refund eligibility is determined under our Refund Policy and applicable consumer protection laws.

We will not intentionally impose undisclosed recurring charges, and we will provide required information and obtain necessary consent before initiating recurring billing.

12

Refunds and Payment Concerns

Our Refund Policy governs refund eligibility, applicable request periods, the treatment of used or unused credits, subscription purchases and renewals, and the processing of approved refunds.

Please review our Refund Policy for the complete terms.

These Terms do not establish a separate refund period or an automatic refund entitlement outside that policy.

Nothing in our Refund Policy or these Terms excludes or restricts any statutory refund, withdrawal, cancellation, or digital-service remedy that applies to your purchase.

If you have questions about a payment, unexpected charge, failed task, credit balance, subscription, or refund request, please contact [email protected]. We will review the matter in accordance with the applicable policy and legal requirements.

13

Deleting Videos and Closing Your Account

You remain in control of the videos stored in your Sharper.video account.

You may delete individual cloud AI-generated, extended, edited, or enhanced videos from your account whenever the applicable deletion controls are available.

You may also delete your account through the available account management controls.

When you delete account content, it is removed from your active account environment. Some limited information may remain temporarily in secure backups or with authorized processors, or may be retained where reasonably necessary for security, legal compliance, payment records, fraud prevention, or the establishment or defense of legal claims, in accordance with applicable law and our Privacy Policy.

Account deletion may result in the permanent loss of access to saved videos, account history, and remaining service entitlements. We encourage you to download any videos you wish to keep before deleting them or closing your account.

Before closing an account with an active subscription, please cancel future renewals through the available billing controls or contact our support team for assistance.

Closing an account does not automatically create a right to a refund. Any remaining payment or refund questions will be addressed under our Refund Policy and applicable law.

You may contact [email protected] for help with video deletion, account closure, or related requests.

14

Privacy and Data Protection

Your privacy is important to us.

Our Privacy Policy explains how we collect, use, store, share, protect, and delete personal information associated with the Services.

It also addresses cloud AI processing, third-party service providers, content safety checks, and the handling of account-related information.

You can review our Privacy Policy.

Where applicable data protection laws provide rights to access, correct, delete, or otherwise control personal information, you may exercise those rights in accordance with our Privacy Policy and applicable law.

15

Intellectual Property and Platform Rights

The Sharper.video name, branding, website design, software, interfaces, proprietary technology, and other platform materials belong to Windvale LLC or its licensors, except for User Content and rights belonging to third parties.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Services for their intended purposes.

This right does not permit you to copy, reproduce, reverse engineer, redistribute, or commercially exploit our proprietary software or platform materials except as allowed by applicable law or with our permission.

All rights not expressly granted remain reserved by their respective owners.

Nothing in this section reduces the rights you retain in your own User Content or Output.

16

Third-Party Technology and Service Availability

Sharper.video may rely on third-party AI models, cloud infrastructure, media-processing technology, and payment services to provide particular features.

The availability, performance, and technical limitations of these components may change.

Generated videos may vary in quality, visual accuracy, duration, motion, resolution, or consistency. Not every output will match a user's prompt or expectations.

Processing can occasionally fail because of technical limitations, unavailable computing resources, unsupported media, network problems, safety restrictions, or third-party service interruptions.

We make reasonable efforts to operate and maintain the Services, but cannot guarantee uninterrupted availability or that every requested result can be produced.

We may perform maintenance, correct errors, implement security measures, or adjust technical capabilities when reasonably necessary.

Nothing in this section limits your rights to remedies for digital services that fail to conform to applicable consumer protection laws.

17

Content Reports and Review Requests

We respect intellectual property, privacy, and the lawful rights of individuals.

If you believe content processed or made available through Sharper.video infringes your rights, involves prohibited material, or otherwise violates these Terms, please contact [email protected].

Include enough information for us to identify the material, understand the concern, and respond appropriately.

For copyright-related concerns, please identify the protected work and the material you believe infringes it, and provide relevant contact information and a good-faith explanation of the issue.

We may request additional information where reasonably necessary and may take appropriate action, including reviewing, restricting, or removing material.

We may also review requests from users who believe their content or account was incorrectly restricted.

Where required, we will provide information about relevant moderation decisions and available review procedures.

18

Suspension and Termination

We may temporarily restrict, suspend, or terminate access to the Services where we reasonably believe an account has materially violated these Terms, created a security risk, engaged in fraud or abuse, or must be restricted to comply with applicable law.

Where appropriate and legally required, we will provide notice, an explanation, or an opportunity to request review.

We may take immediate action when reasonably necessary to prevent serious harm, unlawful activity, or a material security threat.

You may stop using the Services at any time and may close your account through the available controls.

Termination does not eliminate payment obligations already lawfully incurred, refund rights that may apply, or legal rights and obligations that must survive termination.

Sections relating to intellectual property, lawful use of content, applicable payment obligations, liability, and dispute resolution will continue to apply to the extent necessary and legally permitted.

19

Disclaimers and Limitations of Liability

We aim to provide useful, reliable AI video and editing tools. However, artificial intelligence and browser-based media processing involve technical limitations and may produce unexpected results.

To the maximum extent permitted by applicable law, the Services are provided on an "as available" basis, without guarantees of uninterrupted access, error-free processing, or specific creative or commercial outcomes.

You are responsible for reviewing generated material, maintaining backups of important files, and deciding whether an Output is appropriate for your intended use.

To the maximum extent permitted by applicable law, Windvale LLC will not be responsible for indirect, incidental, special, or consequential losses arising from use of the Services where such exclusions are legally enforceable.

Where the law permits a contractual limit on monetary liability, our total liability arising from the Services will not exceed the greater of US$100 or the amount you paid for the Services during the 12 months immediately preceding the event giving rise to the claim.

These limitations do not apply to liability that cannot lawfully be limited or excluded, including liability for fraud, intentional misconduct, or other matters protected by mandatory law.

Nothing in these Terms excludes mandatory consumer warranties, statutory digital-content remedies, or legal protections relating to personal injury, data protection, or other non-excludable rights.

20

Responsibility for Unlawful Use

You are responsible for ensuring that materials you submit and the ways you use generated Output comply with applicable law and do not infringe the rights of others.

To the extent permitted by applicable law, you agree to indemnify Windvale LLC against third-party claims, liabilities, and reasonable costs directly arising from your unlawful User Content, infringement of third-party rights, or material misuse of the Services.

This obligation does not apply to the extent a claim results from Windvale LLC's own unlawful conduct, negligence where liability cannot be excluded, or other circumstances for which you are not legally responsible.

Nothing in this section overrides mandatory consumer protection rights.

21

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, United States, to the extent permitted by applicable law, without regard to conflict-of-law principles.

If you have a concern about the Services, billing, content, or your account, we encourage you to contact [email protected] so we can review the issue and work toward a reasonable resolution.

For disputes that cannot be resolved directly, the applicable courts in Wyoming may have jurisdiction where legally permitted.

If you are a consumer residing in a jurisdiction that provides mandatory consumer protections, applicable local laws and legally protected rights to bring proceedings in the courts of your place of residence are not restricted by this provision.

Nothing in these Terms prevents either party from exercising rights or remedies that cannot legally be waived.

22

Changes to These Terms

We may update these Terms to reflect changes in the Services, applicable laws, security practices, or business operations.

When changes are material, we will provide appropriate notice through the Services or other reasonable means where required by law.

The updated Terms will indicate the applicable revision date.

Changes will not retroactively remove rights that have already accrued or alter existing paid contractual obligations in a manner prohibited by applicable law.

Your continued use of the Services after updated Terms take effect constitutes acceptance to the extent permitted by law.

23

General Provisions

If a provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Our failure to enforce a provision immediately does not constitute a waiver of our right to enforce it later.

These Terms, together with the applicable purchase terms and policies expressly referenced in them, form the agreement governing your use of the Services, subject to rights and obligations imposed by applicable law.

Nothing in these Terms creates an employment, partnership, agency, or joint venture relationship between you and Windvale LLC.
